Elena Kagan Nominated to United States Supreme Court

Today, President Obama nominated Solicitor General Elena Kagan to replace John Paul Stevens on the U.S. Supreme Court. During the confirmation process involving now Justice Sonia Sotomayor, I did almost 50 posts on Sotomayor. If you’d like to check some of them out, type in “Sotomayor” in the search box on the front page of this blog. Justice Sotomayor’s record was much more extensive than that of Ms. Kagan, because Sotomayor had served as both a judge on the U.S. District Court and on the U.S. Circuit Court of Appeals.

All of my Sotomayor posts were designed to predict how she would decide labor and employment law issues. Although Kagan will be harder to predict from a labor and employment law standpoint, the predictions have already begun. I may not be able do 50 posts on Kagan, but I’ll do as many as I can in an effort to discern (or perhaps just guess) where she’ll be on important labor and employment questions.
