CBS Would Rather Rather Stop
The protracted, sometimes bitter, lawsuit filed by Dan Rather against CBS has now been dismissed in its entirety by a New York appellate court. The lower court had dismissed some of Rather’s claims. The appellate court dismissed all the others.
This case has been referred to as a wrongful termination case, but the two remaining claims (now dismissed) were breach of contract and breach of fiduciary duty. Rather must now decide whether to appeal the case to New York’s highest court.
CBS hopes he doesn’t. One CBS executive expressed regret that the 44-year relationship with Rather had ended like it had. Though Rather had previously indicated that he would “go the distance,” there’s some indication he may be rethinking his position.
One reason the case could be over is that it’s estimated that Rather has spent between $2 and $5 million on the case so far. That could be a record amount for an employee in an employment lawsuit. Let’s face it. Most employees don’t have that kind of money. Stay tuned.
