Another Look at Presidential Politics–Predictions for the Workplace–Obama on ADA Restoration Act
The substance of the proposed ADA Restoration Act and the changes its enactment would have on the Supreme Court’s interpretations of the Americans with Disabilities Act have been summarized in a previous post. For a review, click here.
Senator Obama supports this proposed law. Moreover, he has stated that if elected, he will create a National Commission on People with Disabilities, Employment and Social Security to improve the application of SSDI, SSI, Medicare and Medicaid to the disabled and launch an aggressive effort to educate employers about tax incentives for hiring employees with disabilities. In addition to the changes that would be mandated by the ADA Restoration Act, Obama also wants to include scheduling flexibility in the definition of “reasonable accommodation” under the ADA.
This proposal can be added to Obama’s list of things to enact into law if he becomes President.
