Disability Discrimination Case

As reported in an earlier post, the U.S. Supreme Court had accepted Huber v. Wal-Mart Stores, Inc., a case dealing with what constitutes a reasonable accommodation under the Americans with Disabilities Act.  In particular, the case raised the question of whether the ADA requires an employer to reassign a disabled employee to a vacant position for which she is qualified–or merely permits the employee to apply for the vacant position and compete with other applicants.  The parties to this case have settled it, so it has been withdrawn from the Court.
